1. Agreement Overview
These Terms & Conditions (“Agreement”) govern your access to and use of the Energy of Realization program (“Program”), created and provided by Ellina Alexandrovna Schwarz (“Mentor,” “we,” “our,” or “us”), and legally operated under the registered business of Elina Schwarz in Germany (Freiberufler, Steuernummer: 210/273/02480, USt-ID: DE454863354).
By purchasing, accessing, or participating in the Program, you (“Client,” “Participant,” or “you”) agree to these Terms in full. This is a legally binding agreement.
2. Nature of the Program
The Energy of Realization is a 13-week transformational training delivered digitally via an online learning platform. It includes educational video modules, guided meditations, exercises, workbooks, and optional group or individual mentoring depending on your membership tier.
The Program is offered in two formats:
- Evergreen Access – You receive instant access to all materials and begin at your own pace.
- Time-Based Access – The program begins on a fixed start date, and you are guided through the experience as part of a cohort.
Your membership level (Premium, Silver, or Gold) determines the duration of your access and support.
3. Access & Membership Duration
Your access duration is defined by your membership selection:
- Premium Membership – 3 months of access
- Silver Membership – 5 months of access
- Gold Membership – 7 months of access
You are responsible for managing your own timeline within the period granted. Extensions are not guaranteed and are at our sole discretion.
4. Refund & Withdrawal Policy
a) Digital Product Waiver
In accordance with § 356 Abs. 5 BGB (German Civil Code), by purchasing this Program, you acknowledge that:
- You are receiving digital content immediately (evergreen model), or
- You are receiving content in advance of a time-based launch, such as bonus meditations, onboarding emails, or group access.
Therefore, you waive your right to withdraw from this contract under the EU 14-day withdrawal rule.
All purchases are final. No refunds will be issued under any circumstances once the purchase is complete and access is delivered or scheduled.
b) Time-Based Pre-Launch Notice
If you are purchasing the time-based Program in advance of the cohort start date:
- You understand that your participation is reserved, and access begins at the defined start date.
- You will receive pre-start materials, including a bonus meditation. This constitutes partial delivery, and your 14-day withdrawal right is also waived.
5. Payment Terms
You may choose between full payment or a monthly payment plan. By selecting a payment plan:
- You commit to paying the full amount, regardless of your participation, usage, or personal circumstances.
- Failed payments must be resolved within 5 business days. If unresolved, access may be suspended until payment resumes.
- You agree that this commitment is equivalent to signing a financial agreement and that it is not cancellable once initiated.
6. Intellectual Property
All content, videos, meditations, materials, and methods provided in the Program are the exclusive property of Ellina Alexandrovna Schwarz and RealizeOne.
You may not copy, distribute, modify, or resell any content. Access is for your personal use only.
7. Responsibility Disclaimer
This Program is designed for educational and personal transformation purposes. We do not offer medical, psychological, or legal advice. Your results depend on your own effort, engagement, and energy.
You acknowledge that you are solely responsible for your experience, outcomes, and well-being.

9. Applicable Law
This Agreement is governed by the laws of Germany. Place of jurisdiction is the registered business address of Elina Schwarz, unless otherwise required by EU consumer protection laws.
REFUND POLICY
1. Final Sale Policy
Due to the nature of our digital program and the immediate or scheduled delivery of content, all purchases are final.
By purchasing Energy of Realization, you agree to the following:
- No refunds will be issued under any circumstances once access has been granted or reserved.
- This applies to all membership levels: Premium, Silver, and Gold.
- This applies whether you complete the program or not.
2. Digital Content Waiver
Under European Union consumer law (Directive 2011/83/EU & BGB §356 Abs. 5), you are entitled to a 14-day right of withdrawal only if digital content has not yet been accessed or downloaded.
In alignment with these laws, you are asked at checkout to:
- Consent to immediate or scheduled delivery, and
- Acknowledge that this waives your right to withdrawal.
Once this consent is given, your refund right is legally void.
3. Evergreen Program Access
If you purchase the program via evergreen access, you will immediately receive:
- Full or partial content inside the online portal
- Downloadable meditations
- Onboarding guidance
- Community group links (if included)
This constitutes immediate digital access, and no refund is permitted once delivery begins.
4. Time-Based Program Access
If you purchase the program during a pre-launch period for a scheduled start date (e.g., August 8, 2025), you may still receive:
- Pre-start orientation materials
- Downloadable celebration meditation
- Access to the community chat
This constitutes partial program delivery, which begins the contract. As such, you also waive your 14-day refund right under EU law upon purchase.
5. Payment Plan Commitments
If you choose a monthly installment plan, you agree to complete the full payment obligation regardless of participation or completion.
This is a binding financial agreement. Missed payments may result in access suspension until the balance is settled.
6. Exceptions
We do not offer exceptions due to:
- Personal scheduling conflicts
- Non-participation or inactivity
- Change of personal goals or financial situation
